Suposta atuação do ministro do STF em favor do banqueiro Daniel Vorcaro foi noticiado por jornalista do jornal O Globo
A acusação de que o ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), teria atuado sobre o Banco Central em favor do banqueiro Daniel Vorcaro, do Banco Master, noticiada pela jornalista Malu Gaspar, do jornal O Globo, deve ser vista com cautela, na avaliação do jurista Pedro Serrano, professor de Direito Constitucional e pós-doutor em Ciências Histórico-Jurídicas pela Faculdade de Direito da Universidade de Lisboa.
“O caso do ministro Alexandre tem de ser visto com calma. Sem condenações a priori. Esse lance de fontes sigilosas que causam notícias que destroem e vendem muito já vivi, em geral há imensa fraude do real. Vamos com calma, o ministro é muito alvo. É um ministro do Supremo que enfrentou muito por conta da defesa da democracia. Moderação é o que temos de seguir por hora”, escreveu em publicação na rede social X, nesta terça-feira (23).
Segundo a colunista Malu Gaspar, Moraes teria procurado o presidente do Banco Central, Gabriel Galípolo, para conversar sobre um negócio bilionário envolvendo o Banco Master em quatro oportunidades. Seis pessoas diferentes teriam tomado conhecimento dos diálogos pelo próprio presidente do BC e por outros integrantes da instituição.
Em off, Galípolo negou que tenha tratado de algo relativo ao Banco Master com o ministro. Em nota divulgada na manhã desta terça-feira (23), Moraes afirma que encontrou o presidente do BC para tratar das sanções que sofrera, em virtude da aplicação da Lei Magnitsky contra ele e sua esposa, Viviane Barci Moraes, pelo governo de Donald Trump. A medida foi aplicada em 30 de julho e revogada este mês.
Além de Galípolo, Moraes diz ter se encontrado com a presidenta do Banco do Brasil, o presidente e o vice-presidente Jurídico do Banco Itaú, os presidentes da Confederação Nacional das Instituições Financeira, da Febraban, do BTG e os vice-presidentes do Bradesco e Itaú.
“Em todas as reuniões, foram tratados exclusivamente assuntos específicos sobre as graves consequências da aplicação da referida lei, em especial a possibilidade de manutenção de movimentação bancária, contas correntes, cartões de crédito e débito”, diz a nota.
Depois da divulgação de Moraes, o Banco Central também emitiu nota confirmando que “manteve reuniões com o ministro do Supremo Tribunal Federal, Alexandre de Moraes, para tratar dos efeitos da aplicação da Lei Magnitsky”.
A denúncia
A coluna do jornal O Globo afirma que Moraes teria dito a Galípolo que gostava de Daniel Vorcaro e que o Banco Master era combatido por estar tomando espaço dos grandes bancos. O ministro então teria pedido ao presidente do BC que a compra do Banco Master pelo BRB, que tinha sido anunciada em março, fosse aprovada. O BC não aprovou o negócio.
No entanto, outras fontes, ouvidas pela jornalista Daniela Lima, do Uol, informam que as menções ao Banco Master nas conversas entre Moraes e Galípolo foram laterais e se deram no contexto da aplicação da Lei Magnitsky. Segundo essas fontes, também não identificadas, dizer que Moraes pressionou o BC em favor do Banco Master “seria leviano”.
Há também apontamentos sobre a relação da esposa de Moraes com o banqueiro Daniel Vorcaro. Ele realmente contratou o escritório de Viviane Barci de Moraes para representá-lo, mas ela não atuava no caso envolvendo o Banco Master que o levou à prisão na Operação Compliance Zero.
A contratação previa o pagamento de R$129 milhões ao longo de três anos, para prestação de serviços de consultoria e assessoria jurídica ao Banco Master. Um documento sobre a contratação foi localizado pela Polícia Federal (PF) no celular do banqueiro, durante a Operação Compliance Zero.
Repercussão
No Congresso, a oposição estuda utilizar o caso para uma nova carga contra Moraes. O deputado federal Marcel Van Hattem (Novo-RS) já afirmou que deve ser impetrado um novo pedido de impeachment contra o ministro.
Além disso, o senador Alessandro Vieira (MDB-SE) anunciou que deve propor uma Comissão Parlamentar de Inquérito (CPI) para apurar as denúncias. Ambas as ações, porém, só devem ser levadas adiante na volta do recesso parlamentar, em fevereiro de 2026.
O ex-governador do Distrito Federal, agora deputado federal, Rodrigo Rollemberg (PSB) também apresentou um requerimento de Comissão Parlamentar de Inquérito (CPI) à Câmara dos Deputados, para que a casa possa investigar supostas fraudes financeiras entre o Banco Master e o Banco de Brasília (BRB).
Operação da PF e liquidação
Em 18 de novembro, a Polícia Federal (PF) deflagrou a Operação Compliance Zero e prendeu Daniel Vorcaro, dono do Banco Master. No total, os policiais cumpriram cinco mandados de prisão preventiva, dois mandados de prisão temporária e 25 mandados de busca e apreensão, além de medidas cautelares diversas da prisão, nos estados do Rio de Janeiro, São Paulo, Minas Gerais, Bahia e no Distrito Federal.
As acusações incluíam crimes de gestão fraudulenta, gestão temerária, organização criminosa, entre outros. De acordo com a investigação, os detidos praticavam a emissão de títulos de crédito falsos, que eram vendidos a outro banco e, após fiscalização do Banco Central, substituídos por outros ativos sem avaliação técnica adequada.
No mesmo dia, o Banco Central decretou a liquidação extrajudicial do Banco Master. A liquidação significa que o banco perdeu condições de operar, passando a um regime de administração especial temporária. Isso significa que um liquidante – no caso, a EFB Regimes Especiais de Empresas – assumiu o controle do banco para encerrar todas as atividades financeiras, vender os bens e pagar os credores.
Vorcaro e outros sócios do Banco Master foram soltos em 28 de novembro, com um habeas corpus.
