Desde que foi decretada a liquidação do Banco Master, em novembro do ano passado, o assunto não saiu das manchetes dos principais jornais do país. Envolvimento de políticos, acusações a ministros do Supremo Tribunal Federal (STF), atuação criticada do Tribunal de Contas da União (TCU) e compra de influenciadores contra o Banco Central foram alguns dos desdobramentos da liquidação extrajudicial da instituição financeira.

Operação da Polícia Federal
O caso veio à tona quando, no dia 18 de novembro, a Polícia Federal (PF) deflagrou a operação denominada Compliance Zero para combater a emissão de títulos de crédito falsos por instituições financeiras. Na ocasião, a corporação prendeu Daniel Vorcaro, dono do Banco Master, pelos crimes de gestão fraudulenta, gestão temerária, organização criminosa, entre outros. Ele foi solto 10 dias depois.

De acordo com a investigação, ativos fictícios ou supervalorizados foram usados para inflar artificialmente o balanço do Master, sustentando a captação de recursos e mascarando problemas de liquidez que vinham se agravando ao longo de 2024 e 2025.

O núcleo central das irregularidades giraria em torno da emissão e negociação de carteiras de crédito sem lastro econômico real, que teriam sido vendidas para o Banco de Brasília (BRB) sem a devida comprovação documental ou análise técnica adequada. Tais operações resultaram em prejuízos tanto para o BRB quanto para os investidores que adquiriram CDBs do Master.

No mesmo dia da operação, o Banco Central decretou a liquidação extrajudicial do Banco Master. No ofício, o presidente da instituição, Gabriel Galípolo, afirmou que a liquidação ocorreu “em razão do comprometimento da situação econômico-financeira da instituição, com deterioração da situação de liquidez, bem como por infringência às normas que disciplinam a atividade bancária e inobservância das determinações do Banco Central do Brasil”.

Atuação do TCU
Em dezembro, o ministro do Tribunal de Contas da União (TCU) Jhonatan de Jesus acolheu a representação do Ministério Público Federal (MPF) e determinou ao Banco Central uma manifestação sobre os supostos indícios de precipitação na liquidação do Banco Master.

No despacho, o ministro afirmou ser necessário comprovar que a liquidação foi coerente com as irregularidades identificadas e os riscos envolvidos. Ele acolheu os argumentos do MPF, que apontam possível omissão e demora na reação a sinais de deterioração financeira da instituição, o que teria aumentado os riscos ao Sistema Financeiro Nacional, com potenciais impactos sobre credores, investidores, depositantes e o Fundo Garantidor de Créditos (FGC).

Em resposta, o Banco Central enviou uma nota técnica com o histórico do processo e os fundamentos utilizados na decisão pela liquidação. O ministro, no entanto, considerou o documento insuficiente. “A Nota Técnica apresentada se limitou, em essência, à exposição sintética de cronologia e fundamentos, com remissão a processos e registros internos, sem que viesse acompanhada, nesta oportunidade, do acervo documental subjacente (peças, notas internas, pareceres e registros de deliberação) necessário à verificação objetiva das assertivas nela contidas”, destaca na decisão.

Na sequência, o ministro determinou uma inspeção no Banco Central para suprir omissões, preencher lacunas de informação e esclarecer dúvidas identificadas durante as atividades de fiscalização. Nesta quarta-feira (7), no entanto, Jesus suspendeu o pedido de inspeção técnica pelo menos até o fim do recesso no Tribunal, que encerra no dia 16 de janeiro.

Logo após a abertura do processo no TCU, o presidente do Banco Central, Gabriel Galípolo, afirmou que está disponível para prestar os esclarecimentos. “Tem um gabarito completo para que todo o processo se sustente ao longo do tempo. Eu, como presidente, estou à disposição do Supremo para fornecer todos os dados. Já falamos com o Ministério Público e a Polícia Federal, e trouxemos tudo: cada uma das ações que foram feitas, cada uma das decisões, cada uma das trocas de mensagens e cada uma das respostas”, afirmou Galípolo em coletiva de imprensa.

Banco Master fala em irregularidades
Em petição encaminhada ao TCU, a defesa do Banco Master acusou o Banco Central de usar a liquidante para obter dados que reforcem a “decisão extrema” pela liquidação da instituição financeira. Depois que a medida foi anunciada pelo BC, o banco perdeu condições de operar e que, desde então, ficou sob o regime de administração especial temporária. Isso significa que um liquidante – no caso, a EFB Regimes Especiais de Empresas – assumiu o controle para encerrar todas as atividades financeiras, vender os bens e pagar os credores.

Na petição, os advogados disseram que “não cabe ao BCB solicitar ao liquidante a realização de trabalhos de investigação ou de recrutamento de documentos para instruir processos da autarquia ou as respostas que esta tenha que dar às instâncias judiciais ou de controle”.

“Trata-se de expediente inusual, com aparência de ilegalidade e desvio de finalidade, por fazer extrapolar as funções do liquidante e subverter o rito de liquidação extrajudicial, medida na qual tenta transformar: (i) o liquidante em auditor do BCB e responsável por ações de fiscalização que são próprias da autarquia; e (ii) o processo de resolução em investigação de natureza administrativa e/ou criminal”, indicou a defesa do Master.

CPMI do Banco Master e autoridades citadas
O deputado Carlos Jordy (PL-RJ) deve protocolar, em breve, um pedido de abertura de uma Comissão Parlamentar Mista de Inquérito (CPMI) para investigar supostas fraudes envolvendo o Banco Master. O requerimento já reúne o número mínimo de assinaturas, com apoio de 232 parlamentares, mas a instalação da comissão depende da leitura do pedido pelo presidente do Senado, Davi Alcolumbre (União Brasil-AP), em sessão do Congresso.

O documento afirma que o objetivo da CPMI é a investigação “das fraudes financeiras atribuídas ao Banco Master, estimadas em mais de R$ 12,2 bilhões, bem como da tentativa de transferência desses passivos a instituições financeiras públicas ou de controle estatal, notadamente o Banco Regional de Brasília (BRB), além da eventual participação, omissão ou interferência de agentes públicos, autoridades regulatórias, membros de Poderes da República”.

O requerimento cita expressamente o contrato de R$ 129 milhões entre o banco liquidado e os serviços de advocacia de Viviane Barci de Moraes, esposa do ministro Alexandre de Moraes, na defesa do Banco Master e de Daniel Vorcaro junto ao Banco Central, à Receita Federal e ao Congresso.

O documento também menciona a relação entre Vorcaro e Moraes, que participou de pelo menos um dos jantares oferecidos pelo dono do Banco Master em sua mansão no Lago Sul da capital federal, área nobre de Brasília. Também participaram do encontro, no segundo trimestre de 2024, políticos do Centrão, deputados e ex-ministros.

Moraes também teria se encontrado com Galípolo para tratar da situação do Banco Master. Segundo o magistrado, no entanto, as conversas mantidas com o presidente do Banco Central focaram exclusivamente nas restrições impostas pela Lei Magnitsky, aplicada pelo governo dos Estados Unidos contra o ministro e sua família.

“Em nenhuma das reuniões foi tratado qualquer assunto ou realizada qualquer pressão referente à aquisição do BRB pelo Banco Master. Esclarece, ainda, que jamais esteve no Banco Central e que inexistiu qualquer ligação telefônica entre ambos, para esse ou qualquer outro assunto”, diz o texto, que volta a afirmar que o escritório de advocacia de Viviane Moraes “jamais atuou na operação de aquisição BRB-Master perante o Banco Central”, diz a nota do ministro.

Compra de influenciadores contra o Bacen
Uma reportagem de O Globo mostrou que influenciadores de direita foram contatados para fazer propaganda contra a liquidação do Banco Master. Os blogueiros Rony Gabriel e Juliana Moreira Leite, que têm 1,4 milhão de seguidores, por exemplo, receberam uma proposta para divulgar uma reportagem do portal Metrópoles que diz que o “TCU vê indícios de precipitação em liquidação do Master e dá 72 horas para BC se explicar”, do dia 19 de dezembro.

Rony Gabriel (PL-RS), que também é vereador pelo PL em Erechim (RS), afirmou ter sido abordado em 20 de dezembro, pelo Instagram, por um representante da UNLTD Brasil, com proposta de atuação política em um suposto “gerenciamento de crise”. Entre exemplos de publicações em defesa do Banco Master enviados a Gabriel estão posts de Paulo Cardoso, influenciador com 4,3 milhões de seguidores, que se autointitula “hipnoterapeuta e neuropsicanalista”.

Na publicação, Cardoso exibe a manchete do Metrópoles e afirma que “quando um órgão como o TCU entra no caso, é porque tem coisa muito errada”. “Deixa eu te explicar uma coisa muito importante que talvez você não veja em lugar nenhum. Quando um banco é liquidado, ele não some. Os ativos continuam existindo, os clientes continuam lá, as carteiras continuam existindo. Tudo isso continua existindo. Só que entra em liquidação. Ou seja, promoção. Quem tem dinheiro compra barato”, diz o influenciador na publicação.

“Será que ninguém se interessa quando um banco desse tamanho entra em liquidação? Será que isso não vira oportunidade para muita gente grande? É exatamente por isso que o TCU quer uma explicação. Se existiam outras saídas, por que escolheram logo a mais extrema? Por que tanta pressa? Essa história está muito mal contada. A quem interessava a liquidação tão rápida do Banco Master?”, conclui.

À imprensa, Paulo Cardoso negou ter firmado qualquer contrato para a publicação de vídeos e alegou que seus vídeos sobre “atualidades” são baseados “em notícias que saem na mídia” e que não se considera um “influenciador político”, mas, sim, um produtor de conteúdo nas redes sociais voltado para “pessoas que buscam liberdade espiritual, emocional e mental”.
