Ministro do STF anula provas decorrentes de acordo de leniência da empreiteira Odebrecht na Operação Lava Jato
A prisão do hoje presidente Luiz Inácio Lula da Silva (PT) foi uma “armação” e “um dos maiores erros judiciários da história do país”. Quem afirma é o ministro Dias Toffoli, do Supremo Tribunal Federal (STF), que anulou nesta quarta-feira (6) todas as provas obtidas por meio do acordo de leniência da construtora Odebrecht e dos sistemas de propina da empresa no âmbito da Operação Lava Jato.
A decisão de Toffoli foi publicada em resposta a pedido da defesa de Lula, que garantiu acesso aos arquivos da Operação Spoofing, que investigou o hackeamento de telefones celulares do ex-juiz Sergio Moro e do ex-procurador da República Deltan Dallagnol.
No texto em que confirmou a anulação das provas, Toffoli disse que a prisão de Lula foi “fruto de um projeto de poder de determinados agentes públicos em seu objetivo de conquista do Estado por meios aparentemente legais, mas com métodos e ações contra legem [‘contra a lei’, na tradução para o português]”.
Em manifestação contundente, o ministro do Supremo prosseguiu dizendo que a atuação dos agentes públicos que culminaram com a prisão do então ex-presidente, em abril de 2018, deu início ao processo que levou o país às recentes ameaças de ruptura democrática. Lula ficou 580 dias preso em Curitiba, e saiu após decisão do Supremo de anular a prisão após decisão judicial em segunda instância.
“Digo sem medo de errar, [a prisão] foi o verdadeiro ovo da serpente dos ataques à democracia e às instituições que já se prenunciavam em ações e vozes desses agentes contra as instituições e ao próprio STF. Ovo esse chocado por autoridades que fizeram desvio de função, agindo em conluio para atingir instituições, autoridades, empresas e alvos específicos”, escreveu Toffoli.
O ministro argumentou ainda que houve desrespeito ao devido processo legal e a decisões judiciais superiores, provas forjadas, ações com parcialidade e fora da esfera de competência dos agentes públicos, que, para ele, “não distinguiram, propositadamente, inocentes de criminosos”. Mais que isso, os envolvidos valeram-se “de uma verdadeira tortura psicológica, UM PAU DE ARARA DO SÉCULO XXI, para obter ‘provas’ contra inocentes”, escreveu o ministro em caixa alta.
Em sua decisão, de 135 páginas, Toffoli publicou parte dos diálogos vazados que envolveram agentes como Moro e Dallagnol. O ministro reconheceu que a operação investigou “ilícitos verdadeiramente cometidos, apurados e sancionados”, mas que usou a alegação do combate à corrupção para “levar um líder político às grades, com parcialidade e em conluio, forjando-se ‘provas'”.
“Para além, por meios heterodoxos e ilegais atingiram pessoas naturais e jurídicas, independentemente de sua culpabilidade ou não. E pior, destruíram tecnologias nacionais, empresas, empregos e patrimônios públicos e privados. Atingiram vidas, ceifadas por tumores adquiridos, acidentes vascular cerebral e ataques cardíacos”, destacou sobre os agentes envolvidos.
Tortura institucional
A decisão de Toffoli acontece dentro de um contexto em que o ministro do STF busca uma reaproximação com o presidente Lula, visto que a relação com o presidente se encontra fortemente abalada desde o episódio em que o juiz da Suprema Corte não permitiu a ida do líder petista ao velório de seu irmão, Vavá.
Genival Inácio da Silva, o Vavá, faleceu aos 79 anos vítima de um câncer. À época, Lula estava preso, e sua defesa entrou com um pedido para que ele pudesse ir ao velório. O pedido foi negado pela juíza federal Carolina Lebbos, da 12ª Vara Criminal de Curitiba, e pelo desembargador Leandro Paulsen, do Tribunal Regional Federal da 4ª Região.
Dessa maneira, o caso chegou ao ministro Toffoli, que apresentou uma solução esdrúxula para o caso: Lula poderia se reunir com sua família em uma unidade familiar para onde o corpo de Vavá poderia ser levado antes do sepultamento. Lula agradeceu, mas não aceitou a proposta do magistrado.
Durante o velório de Vavá, a deputada federal e presidenta do PT, Gleisi Hoffmann (PT-PR), transmitiu uma mensagem de Lula, que classificou a decisão de Toffoli como “maldade”.
“Não deixaram que eu me despedisse do Vavá por pura maldade. Não posso fazer nada porque não me deixaram ir. O que eu posso fazer é ficar aqui e chorar”, declarou Lula à época.
O caso foi classificado como “tortura institucional” por vários especialistas da área jurídica.

“Perdão”
Durante a cerimônia de diplomação de Lula, em dezembro de 2022, para o seu terceiro mandato presidencial, o ministro Dias Toffoli se aproximou do mandatário e pediu o seu perdão pelo fato de tê-lo impedido de velar o seu irmão.
“O senhor tinha direito de ir ao velório. Me sinto mal com aquela decisão, e queria dormir nesta noite com o seu perdão”, declarou Toffoli ao presidente Lula.
Segundo a jornalista Mônica Bergamo, o presidente Lula teria dito para o ministro ficar tranquilo e que conversaria com ele em outro momento sobre a questão, de maneira reservada.
Contornar erros
O ministro Dias Toffoli foi indicado pelo presidente Lula ao STF durante o seu segundo mandato, em 2009.
Toffoli já tinha passagem, como advogado, pelo Partido dos Trabalhadores (PT) e pela Advocacia-Geral da União (AGU). Dessa maneira, era visto como um quadro progressista a ocupar uma cadeira na Suprema Corte.
No entanto, com a eclosão da crise política e institucional provocada pelas Manifestações de Junho de 2013, e com o alvorecer da Operação Lava Jato, Dias Toffoli passou a colecionar uma série de declarações duras contra o governo comandado pelo PT e contra Dilma Rousseff e Lula.
Porém, em 2019, primeiro ano de governo Bolsonaro, Toffoli tomou a decisão de abrir o inquérito das Fake News, em curso até hoje sob o comando do ministro Alexandre de Moraes.
Um ano após a abertura do inquérito, Toffoli, que era presidente do STF, falou sobre os ataques às instituições brasileiras. “Aqueles que estudaram a história do Brasil sabem e têm noção de que não foi uma decisão fácil. Foi a decisão mais difícil da minha gestão a abertura do inquérito. A gente viu o início de uma política de ódio que quer destruir instituições e instalar o caos”, afirmou o ministro.
No entanto, Toffoli falou sobre a sua relação com o ex-presidente Jair Bolsonaro e que, naquela época, não identificava “atitudes antidemocráticas” do ex-mandatário e seus ministros.
“No relacionamento que tive com o presidente Jair Bolsonaro e seus ministros, nunca vi diretamente nenhuma atitude contra a democracia. Além disso, tive uma ‘convivência mais intensa’ com Bolsonaro nos últimos anos para fazê-lo compreender que cabe ao Supremo declarar inconstitucional determinadas normas e cabe a ele respeitar. E ele respeitou”, disse Toffoli, em abril de 2020.
De lá para cá, Lula se tornou presidente, e Jair Bolsonaro e sua horda de fanáticos tentaram dar um golpe de Estado. Neste contexto, Toffoli parece buscar contornar alguns erros históricos de sua recente carreira no Supremo Tribunal Federal: pedir perdão a Lula e colocar a Operação Lava Jato em seu devido lugar no que diz respeito a uma série de ilegalidades cometidas durante o seu auge.
