O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), votou nesta sexta-feira (28) para condenar cinco dos sete integrantes da ex-cúpula da Polícia Militar do Distrito Federal.
Eles são julgados por omissão aos atos golpistas de 8 de janeiro de 2023. Na decisão, o ministro entendeu que deveriam ser absolvidos os réus Flávio Silvestre de Alencar e Rafael Pereira Martins (entenda mais abaixo).
O julgamento, que começou nesta sexta (28) e vai até 5 de dezembro, é realizado pela Primeira Turma do STF.
Além de Moraes, também votam os ministros Flávio Dino, Cármen Lúcia e Cristiano Zanin.
São julgados sete policiais que integravam a cúpula da Polícia Militar do DF à época dos ataques de 8 de janeiro.
Moraes votou para condenar:
- Fábio Augusto Vieira (comandante-geral da Polícia Militar do Distrito Federal à época dos fatos);
- Klepter Rosa Gonçalves (à época, subcomandante-geral);
- Jorge Eduardo Barreto Naime (coronel da PMDF);
- Paulo José Ferreira de Sousa Bezerra (coronel da PMDF);
- Marcelo Casimiro Vasconcelos (coronel da PMDF).
O ministro propôs pena de 16 anos aos réus, sendo 13 anos e seis meses de reclusão (em regime fechado), dois anos e seis meses de detenção (em regime semiaberto ou aberto), e 100 dias-multa (cada dia multa no valor de um terço do salário-mínimo).
Ele também votou pela perda de cargos públicos dos cinco réus.
Moraes, porém, votou para absolver dois réus. São eles:
Rafael Pereira Martins (tenente da PMDF).
Flávio Silvestre de Alencar (major da PMDF);
